FL Highway Patrol Trooper, Scott Kuntsmann, arrested for fabricating arrest reports

Sarasota, FL -- FHP Trooper Scott Kunstmann's dash camera was rolling when he pulled over 71-year-old Robert Culbertson on I-75 back in 2011.  

Culbertson was allegedly weaving, so Kunstmann asked a series of questions to determine if a field sobriety test was warranted, and asked another trooper for assistance.  

Culbertson admitted to having one beer three hours prior.  In the police report, Kunstmann indicated he smelled alcohol on Culbertson's breath, but in the dash cam video, the two officers are heard on tape agreeing that they couldn't smell alcohol.   

Kunstmann arrested Culbertson anyway, but didn't realize at the time he was a former criminology professor, who would later contact an attorney.

The attorney read the affidavit, watched the video, and found inconsistencies in the stories.

Fast forward to March of this year when Kunstmann pulled over another driver, this time a female from Ukraine, and performed a sobriety test.  

In his report, Kunstmann indicated the woman was "belligerent and cussing," yet none of that was seen or heard on the video, and she clearly passed the test.

Following an investigation by the Florida Department of Highway Safety and Motor Vehicles, it was determined Kunstmann not only fabricated arrest records, but also was untruthful during deposition.  

He was arrested for perjury, and subsequently relieved of duty.

Kunstmann had been on paid administrative leave while the investigation was ongoing. As a result, Culbertson and his attorney Andrea Mogensen, may file a lawsuit against the department.
