MIAMI (AP) - A federal appeals court will hear oral arguments in the case of a Florida mass killer.
The U.S. Court of Appeals for the Eleventh Circuit said Friday that it will hear the arguments in John Errol Ferguson's case on Nov. 29.
Ferguson's lawyers claim he suffers from mental illness so severe that he isn't competent and shouldn't be eligible for the death penalty. The 64-year-old Ferguson is a paranoid schizophrenic.
The federal appeals court blocked his scheduled execution by injection in October and the U.S. Supreme Court upheld the stay.
He was convicted of killing eight people in Miami-Dade County in 1977 and 1978.
