Man charged with aggravated assault for shooting over a cellphone

HILLSBOROUGH COUNTY, Fla. --  A group of four friends discovered a cellphone in the backseat of an Uber on the ride home after leaving the Dallas Bull nightclub on Friday around 3 a.m, according to the Hillsborough County Sheriff's Office.

The group made plans to meet up with the owner of the phone after getting in touch with the boyfriend of the owner, identified as 36-year-old Daniel Smith. The group met with Smith to give back the phone.

During the interaction, Smith took out a handgun, shooting twice at the ground before shooting towards the group of friends. Justin Medina exchanged fire with Smith, striking him five times. 

The group of friends called 9-1-1 and the Uber driver who had transported Smith to the meeting drove him to St. Joseph's Hospital South to be treated for gunshot wounds. 

Smith was arrested after being released from the hospital on Wednesday. He is being charged with four counts of aggravated assault with a deadly weapon. There are no pending charged being filed against Medina at this time.
