Tampa, Florida -- Five years after she says she was raped then hauled off to jail, a Bay area woman has been given the green light to sue the Hillsborough County Sheriff's Office.
Back in 2007, the 21-year-old USF student told Tampa police she was sexually assaulted after Gasparilla.
She had been prescribed the morning-after pill, but during the investigation, she was taken to the Hillsborough County Jail for non-payment of restitution for a juvenile crime.
Her attorney says a jail nurse denied her request for her prescription, a violation of her privacy and equal protection under the law.
A U.S. district judge recently ruled she can sue the sheriff's office.
Her attorney, Virlyn Moore III, says he plans to see the case go to court within the next year.
