Nightclub owner threatens to sue condo association

Sarasota, Florida -- Some Sarasota condo owners have repeatedly complained about the noise from a nightclub on the ground floor of their building, but did they go too far? The club owner thinks so, calling it harassment.

Sitting along Main Street is Ivory Lounge an upscale nightclub popular at night with customers, but not with neighbors living above from the Plaza Five Points Condo Association. They've complained about the noise for two years.

"We have not been in violation of anything," says club owner Ambrish Piare.

Besides Ivory Lounge, Piare owns two other businesses along Main Street -- Café Americano and Jalea. Piare says after two years of unfounded noise complaints, his attorney has put the condo association on notice. They plan to sue for harassment, slander, defamation and discrimination.

"The facts do not support the perception they've created about my business and downtown. It impacts sales, impacts the value of my business, it impacts my pleasure of running this business."

Piare says he's tried working it out civilly: hiring the city's noise consultant for $25,000, making changes to the speakers, adding security at the club, getting rid of the glassware to limit the noise -- and yet the complaints continue.

"It will never, ever stop. I cannot run my business constantly looking over my shoulder."

According to Piare the condo association took extreme steps by trying to terminate his lease and getting the city to pull his permit.

"That in my opinion is harassment," says Piare.

10 News asked the Plaza Five Points Condo Association to share their concerns about Ivory Lounge, but they denied our request due to pending litigation.

Piare believes the noise has never been the real problem with the condo owners.

"The problem is not about Ivory, my business. It's about the future of the downtown -- they don't like where it's going."

The City has approved nearly 1,000 new hotel rooms and about 500 luxury condos and apartments to be built over the next few years.

"If you are unhappy with the sound and the vibrancy now, trust me, it will not get better, not with so much more people here."
