Charges dropped in North Port officer's sexual battery case

North Port, Florida -- Criminal charges have been dropped against the North Port Police officer charged with sexual battery and false imprisonment.

Back in March this year, Melanie Turner was arrested and charged in the incident.

The probable cause affidavit stated another officer, Ricky Urbina, handcuffed her, then he and Turner took the victim into a bedroom and sexually assaulted her. Urbina took his own life before a warrant for his arrest was served.

Following Turner's arrest, her attorney Eric Reisinger had said she and the victim were "close" before this. He also said Urbina took a polygraph test during the investigation and passed.

"He passed it -- that it was 100% consensual," said Reisinger.

He says both officers were shocked at the allegations.

The State Attorney's report released Monday concluded that there was not enough demonstrable evidence, beyond a reasonable doubt, that the victim showed a lack of consent.
