St. Petersburg woman files suit against Lindsay Lohan

St. Petersburg, Florida-- A local chemist, who claims she was contacted to develop a sunless tanning spray, says actress Lindsay Lohan and her business partners stole a custom made formula to sell and market for themselves.

The tanning mist went on sale nationwide in May and is available in Tampa at International Plaza through cosmetics retailer Sephora. Each can sells for $35.00.

In a federal lawsuit filed Friday in Tampa, St. Petersburg chemist Jennifer Sunday claims to have created the mist, after requiring Las Vegas business woman Lorit Simon to sign a confidentiality agreement. The lawsuit goes on to claim that after coming up with a formula everyone loved, the deal fell through when the two parties could not come to an agreement on the sale price for the product.

Sunday develops cosmetic lotions for St. Petersburg based White Wave International Labs.

Soon after, the lawsuit claims a product called "Sevin Nyne" with the same ingredients appeared on store shelves.

"She was outraged. Absolutely outraged," said attorney Marcia Cohen, who is representing Sunday on the case. "Not only did she suspect it was her formula, but they were very clear on the ingredients. The ingredients were exactly what Miss Sunday had put into her formula for the sunless tanning mist."

On the back of the box, a description of the product states Sevin Nyne was developed for more then three years by Lohan and celebrity airbrush tanner Lorit Simon.

10 Connects attempted to reach the company selling Sevin Nyne Tanning Mist through their website but did not hear back as of Monday night.

Cohen says her client has convincing evidence, including e-mails and the confidentiality agreement providing proof the formula was stolen.

If the case does go to trail, Lindsay Lohan would most likely be called to Florida to testify. It would be up to a judge and jury to determine how much, if anything, the St. Petersburg chemist would be awarded.
