TAMPA, Fla. - The defamation lawsuit involving Todd MJ Schnitt and Bubba the Love Sponge Clem will continue Monday, for now. This comes after a judge ruled to reserve the right for a mistrial after a hearing Friday.
"It's like a South Park episode and I'm quite frankly getting a little tired of it," said Bubba the Love Sponge Clem, after he left the courthouse.
"We're going to abide by the judge's ruling. Let the jury decide this. The mistrial is a reserve ruling. We're not disqualified, so we're going to let the jury decide this. We're going to win this case on the facts," said one of Clem's attorneys, Joseph Diaco.
Neither Todd MJ Schnitt nor his legal team had anything to say about the judge's decision.
This all comes after an attorney for Schnitt Friday accused Bubba's legal team of orchestrating Wednesday's DUI arrest of Schnitt attorney, Phil Campbell. Jonathan Ellis accused a paralegal on Bubba's team with getting Campbell drunk at Malio's, asking him to move her car, and then someone from Bubba's team calling the cops.
"They set this thing up from day one. The sting, the circumstances, and the subsequent media blowout that they engaged in shortly after the incident was revealed," said Schnitt attorney, Jaime Austrich.
Bubba's legal team strongly denies it.
Meanwhile, during a hearing Friday afternoon on the mistrial motion, Bubba attorney. Steven Diaco, refused to answer a number of questions and invoked the 5th amendment. So did the paralegal in the center of it all, Melissa Personius.
Also, a Tampa police officer who arrested Campbell for DUI testified he was tipped off by someone on Bubba's legal team.
Again, the trial does continue Monday, however the judge said he wants to do more research on the mistrial motion before he rules.
