The Dalles, OR (CNN) - Police suggest he's no dad of the year. Jose Torres appeared in court facing a variety of charges after a trooper found his 10-year-old son behind the wheel. The dad was drunk say the police.
"We feel bad for that 10-year-old boy that he was put in that position, "said Lt. Grett Hastings of the Oregon State Police.
Sunday morning troopers notices Torres' S-U-V driving erratically in the Dalles. It was swerving and stopping in the middle of the street with the hazard lights on. Officers say it appeared that the passenger was steering. When a trooper pulled the vehicle over, he was surprised to find a little boy in the driver's seat. And police say the passenger; the boy's father was drunk. Photos from the scene show beer cans everywhere.

The prosecutor says Torres had a blood alcohol level almost three times the legal limit.
One resident said, "That's just unbelievable, completely unbelievable, for parents to be that irresponsible, especially with their children."
The 10-year-old boy is now with his mother and the case has been referred to child protective services for follow-up.
The 34-year-old dad bailed out of jail. Using a friend as a translator, Torres says he was fulfilling his son's desire to drive. He went to an isolated area and he let the 10-year-old take the wheel. He says he only had four beers and his son was never in danger.
Torres has a history of drinking, including four prior arrests.
