New Port Richey, Florida - A 13-year-old boy who stands 5'11 and weighs 240 pounds is accused of strangling his teacher on Thursday.
The incident took place midday at AMI Kids School, a facility contracted by the Pasco County School District to help at risk youth.
According to an affidavit from the New Port Richey Police Department, the teacher tried to split up an argument between the suspect and another student who were fighting over a seat in class.
During the fight the teacher, Jennifer Baldwin, stepped in to break it up when the 13-year-old wrapped his hands around her neck and tried to strangle her.
Two other students in the class stepped in and pulled the suspect off Baldwin.
She is expected to return to work on Monday.
Dennis Smith, the suspect's uncle, says his nephew is generally a good kid but notices the anger issues surface after staying with his mother at her house.
"Between his mother and his step-brother causing all kinds of problems, whenever he stays over there he does nothing but wrong things."
Right now, he is hoping to get the boy help with his anger issues after dealing with the court case ahead.
"It was scary enough for him to even think about doing that with a teacher - I would assume he's got a bad temper," said Smith.
