Clearwater, Florida -- A Largo man was arrested for DUI and child neglect outside a fast food restaurant Super Bowl Sunday after police found him intoxicated behind the wheel with his 4-year-old son in the back seat.
Shortly after the game, around 10:30 p.m., David Timothy Higgins pulled into the drive-thru at the Wendy's at 900 S. Missouri Ave. to order food. The manager noticed he was intoxicated and had a child in the back seat, so she asked him to pull his car over while she waited on his food to cook. Instead, she called Clearwater Police.
When the officers got there they noticed Higgins' eyes were bloodshot, his speech was slurred, his breath smelled like alcohol, and he failed several sobriety tests.
He told officers he had been watching the Super Bowl and had consumed five beers. When asked why he was driving with a child in the car, he said he didn't think he was that intoxicated.
Higgins, 26, was taken to the Pinellas County Jail, and this is not his first DUI. He also was arrested on a similar charge by St. Petersburg police in June 2012.
