Tampa, Florida- "We've made an arrest in the tragic and unnecessary death of Fred Turner," says Colonel Donna Lusczynski with the Hillsborough Sheriff's Office.

Two men from the Orlando area Fred Turner, 47, and Jerome Hayes, 48, crossed paths in Tampa this weekend. Turner ended up dead, and now Hayes has been charged with first degree murder, and is being held without bond at the Hillsborough County Jail.

"This is not a case of road rage. Unfortunately, this is a case of mistaken identity wrong place wrong time,"Lusczynski said at a press conference Monday afternoon.

Investigators with the Hillsborough Sheriff Office said around 3 p.m. Saturday afternoon, 48-year-old Jerome Hayes followed 47-year-old Fred Turner onto I-4. While he was driving, deputies said Hayes pulled out his gun and shot Turner through the passenger window three times in the upper body- killing him.

The incident closed the interstate between US 301 and I-75 for nearly eight hours.

According to deputies, the shooting was the result of a fight between Hayes and a friend, with another man at the Tampa Gold Club on Adamo Drive.

Lusczynski said Hayes and his friend were ejected from the club and they waited in their car for the customer they had a fight with to come out. The customer heard the men were waiting for him and did not leave the club.

"Unfortunately the victim came out at the same time, and they thought he was that man and followed him onto the interstate," Luscyznski explained.

When Turner noticed Hayes and his friend following him, he called a 911 operator and gave her a play-by-play of what happened, up until the gun shots rang out.

"It's going to be a key piece of evidence. You have the victim's version of the events to the extent that he can provide," said Nicholas Matassini, Hayes' Tampa attorney.

Matassini said his client is cooperating with investigators and voluntarily turned himself in at the Hillsborough County Jail Monday morning. He said his client knows he has a difficult road ahead.

"He's nervous; he's scared. He's a hard-worker though and he's got significant ties to the community," Matassini said before adding that he his family and kids here in Tampa have him, "understandably distressed at the allegations that he did this without legal justification."

Deputies say Turner was not in The Gold Club Saturday afternoon but at another business in the same building calledTres Equis- an adult theater, store and arcade.

Investigators are questioning Hayes' passenger in the car and say he too may face charges.

Additionally, they explained how they found Hayes- saying they tracked him to his home in St. Cloud using surveillance cameras. When deputies arrived around 3 Sunday morning, Hayes' attorney said he cooperated and gave deputies his gun and his car- a grey Taurus.

Deputies said Hayes has not confessed to the murder.
