Gulfport, Florida -- Pinellas County prosecutors say they will not charge a school bus driver for not intervening in a fight between students last month.

Cell phone video recorded on John Moody's bus on July 9 showed three 15-year-old students from Lealman Intermediate Schoolbeating a 13-year-old. The victim was left with a broken arm, cuts and bruises.

The video that captured the fight also showed no one trying to stop it, not even the bus driver. Moody, 64, is a 17-year veteran with the school district.

"When the fight started on the bus, he did stop the bus and calldispatch," explains Melanie Marquez Parra, spokesperson with thePinellas School District. But police say Moody did little else.

Moody retired following the school district's internal investigation and Gulfport Police turned the case over to the state attorney's office for prosecution. But on Thursday, prosecutors said Moody's actions -- or lack thereof -- did not rise to the level of child neglect.
