(Tallahassee.com) Christina West, who was injured in a DUI arrest by Tallahassee police in an incident caught on dash-cam video, entered a plea agreement with prosecutors allowing her to avoid a criminal conviction.

West, who was arrested Aug. 10 on DUI and four felony battery and assault charges after crashing her SUV into a house in Killearn Estates, entered a no-contest plea Monday to misdemeanor charge of reckless driving.

Adjudication was withheld, meaning she was not convicted of a crime. All of the felonies in the case were previously dropped by prosecutors.

As part of the plea deal, West must serve six months of probation and get tested for drugs and alcohol once a month for the first three months of her probation, according to Leon Circuit Court records.

West suffered a broken cheek bone and other injuries during her arrest, which was captured on a Tallahassee Police Department dashboard camera. Video of the arrest went viral after the Tallahassee Democrat published it Sept. 10.

The two officers directly involved in her arrest, Chris Ormerod and Matthew Smidt, were suspended for 80 hours and 40 hours respectively. Their supervisors, Sgt. George Creamer and William Faust, received 20-hour suspensions.

A Leon County grand jury in November opted not to charge any of the officers involved in the arrest, instead issuing a mildly-worded presentment saying TPD was responsible for her injuries and needlessly escalated the encounter.

Tallahassee attorney Fred Conrad said the negotiated agreement with prosecutors means West avoided both trial and criminal conviction.

"We felt like we had a very strong case in the event that we decided to litigate," Conrad said ."But given the injuries that my client has suffered at the hands of the police department, the decision was made between me and Christina and her family that a trial at this stage in her recovery would be detrimental to her recovery, which is why we settled."

West has notified the city of her intent to sue over the arrest.
