A cell phone video of an altercation between a man and a Florida Highway Patrol trooper in which a shot was fired was released by the State Attorney's Office in Tallahassee Monday.
Sherlin Herard was arrested May 8 after he unexpectedly attacked the trooper in the parking lot of Seminole Grand Apartments. He had been posting notes on the trooper's car throughout the week with derogatory messages, according to court documents.
When the trooper observed Herard sitting on his patrol car he asked the 22-year-old to move and the two began to argue, after which Herard punched the trooper.
When he was confronted, Herard said "I've been waiting on you," and admitted to leaving the notes.
The trooper's off-duty concealed firearm fell out onto the ground and the two wrestled for it, resulting in one round firing into the front driver's side window, court records show.
Herard, who was arrested on charges of aggravated assault with a firearm, aggravated stalking and felony battery, pleaded not guilty to the charges May 19 and the case remains in the discovery phase by the State Attorney's Office.
Herard remains in the Leon County Jail without bond.
