Winter Haven, Florida -- Winter Haven Police say an alleged burglar was shot to death as he tried breaking into a home on Monday morning.
Police Chief Gary Hester says the Pena family awoke shortly before 7 a.m. to the sound of somebody rattling the back doors of their house in the 4200 block of Lake Marianna Drive.
One family member saw an intruder standing at the back door, trying to break into the home. That's when at least three of the family members reportedly armed themselves.
One of those family members fired a warning shot above the back doors, telling the intruder to leave,
But the Penas tell police that the person continued to try to enter their home. Police say at least two of the family members then opened fire, killing the suspect in the kitchen area.
Investigators say they are in the process of trying to confirm the identity of the suspect and notify his next of kin. The suspect is believed to be a 40-year-old man from the Winter Haven area whose previous arrest record includes aggravated assault and domestic violence.
Police say the Pena family is being cooperative and if it the shooting was indeed self-defense, no charges are expected.
