DELRAY BEACH, Fla. -- A millionaire health club mogul was sentenced to two years house arrest for a 2016 crash that killed an 82-year-old Uber driver, CBS12 reported.

Roger Wittenberns, 62, was charged with driving drunk. Investigators said he was going at least 75 mph in a 35 mph zone when he crashed his yellow Lamborghini into 82-year-old Gerald Smith, who was pulling out from a cross street near US 1, just north of downtown Delray Beach.

Investigators said Smith was on his way home for dinner.

CBS12 said the plea deal originally had Wittenberns spending two years in Palm Beach County Jail. But because of his age and declining health, he'll be allowed to do two years on house arrest along with serving 10 years probation and paying $20,000 restitution.

In court on Monday, CBS12 said Wittenberns took responsibility for his mistake and apologized to the Smith family.
