FedEx driver won't be charged after fatally punching stranger

The district attorney won't prosecute a truck driver who fatally punched a stranger who insulted him.

PORTLAND, Oregon -- A FedEx driver won't be charged for fatally punching a stranger who called him racial slurs, including the N-word, and tried to hit him after yelling at him to slow down in Portland.

According to The Oregonian, prosecutors determined there's no reason to believe Timothy Warren meant to kill Joseph Magnuson when he punched him above the eye in late September, after stopping his truck to defend himself against the racial insults being yelled his way.

Warren was only going 5-20 mph, according to Newsweek.

The publication explained Warren's fatal punch qualifies as self-defense because Magnuson allegedly threw a drink at him during the confrontation and tried to punch him first, according to the district attorney.

Magnuson was reportedly already suffering from health problems that contributed to his death.

According to Fox News, Oregon law doesn't require someone to retreat, so Warren was legally allowed to stop his truck and respond to Magnuson's verbal and physical aggression.
