WATCH: Port Orange man did not want to waste a drop of beer while at gunpoint

The man had two beers in his hand while Port Orange police held him at gunpoint.

PORT ORANGE, Fla. — A northeastern Florida man didn’t want to waste a drop of his cold beer as Port Orange police officers attempted to apprehend him for allegedly shooting at his neighbor Tuesday night.

Police arrived at a man’s house Tuesday night in a Port Orange neighborhood, where the man told them his neighbor threatened him with a gun. 

While the man and police were talking about the incident, Brett McPeek reportedly walked out of his house and started shooting in their direction. Many other neighbors were outside at the time as well, a Port Orange Police Department Facebook post said.

Body cam video captures the moment officers dialed into McPeek’s location, guns drawn, finding him with two beers in his hand. First, he told officers he wanted to drink the beer, then he opened them.

“Well, I wanna drink this beer. Is that cool?” McPeek can be heard asking the officers.

Aggravated Assault Incident

Aggravated Assault w/ Firearm POPD Case # PO240002139 Last night (04/16/2024), officers responded to a neighbor disturbance where one neighbor was threatened with a firearm by the other. Officers arrived on scene and while investigating, the suspect, identified as Brett McPeek, exited his residence and fired a firearm in the area of the officers, victim, and several neighbors who were outside at the time. Officers moved in toward the sound of the gunshot and located Brett McPeek outside the front of his residence. Officers negotiated with Brett McPeek and were able to safely take him into custody. Brett was not in possession of the firearm at the time of arrest and a search warrant was executed for the property. Two handguns were recovered, one being a .38 Special revolver with a spent shell casing. Brett McPeek was booked into the Volusia County Branch Jail with no bond for aggravated assault with a firearm and using a firearm while under the influence of alcohol. BWC Video below

After officers safely apprehended him, they searched his home and found a .38 Special revolver with a “spent shell casing,” the post said.

Police booked McPeek into the Volusia County Branch Jail with no bond. He faces charges of aggravated assault with a firearm and using a firearm while under the influence of alcohol.

No one was hurt before or during the ordeal.
