Police says man involved in deadly Haines City shooting won't face charges

He claimed self defense.

HAINES CITY, Fla. — The Haines City Police Department said a man shot another man in self-defense Sunday.

Police said Bernard Shell, 26, was shot after a fight around 3:15 p.m. Sunday outside of Family Discount Supermarket on Dr. Martin Luther King Jr. Way.

Shell was accused of stealing another man's wallet inside the store and was confronted by the man. Police say a struggle for the gun happened after Shell threatened to kill the man with a gun. The man was able to grab the gun from him and shot him four times. 

Both men were taken to the hospital where Shell later died from his injuries, according to officers.

"This is a truly unfortunate event," Chief Jim Elensky said. "Our thoughts are with all of those involved and their families."

Based on an early investigation by Haines City police, the man accused of shooting Shell is not facing any charges at this time. Police said he claimed self-defense and is cooperating with the investigation. Surveillance footage also backed his claims, according to officers.
